Standards of Behavior for Industry and Industry Agents

Definitions

  • Consumers are persons who have a bleeding disorder and their family members (or caretakers) who may, at some point in time, use the goods and/or services provided by Industry.
  • Industry is defined as companies that manufacture clotting factor products or profit from the sale of clotting factor products or additional medical treatments used by members of the bleeding disorders community. This includes, but is not limited to, manufacturers, specialty pharmacies, HTCs with a 340b program, and home care companies.
  • BDH Chapter Event may include, but is not limited to, a meeting, educational program, camp, outing, social gathering, retreat, support group, or fundraising activity.
  • An Industry Representative is an individual who is compensated by Industry either on a full-time, part-time or contract basis to provide a specific task. An Industry Representative can be a consumer, or a member of the bleeding disorders community. An example of an Industry Representative could be a consumer that is compensated to speak about a specific product on behalf of a company. Please note: if an individual is a representative of an HTC participating in the 340B program, that individual may also be considered an industry representative depending on the individual’s role and/or involvement with the 340B program.
  • An Exhibit is a table or other mechanism for displaying Industry marketing materials at an Event. Exhibits may be restricted to designated areas and time frames.

Bleeding Disorders of the Heartland (BDH) welcomes everyone in its efforts to support the community of persons affected by bleeding disorders. BDH is a non-profit organization; we do not endorse any pharmaceutical product, specialty pharmacy, or home care service. We recognize that our community includes many who are employed by or otherwise associated with Industry. We are also aware that Industry employs some persons who are themselves affected by a bleeding disorder and who are a direct part of the community supported by BDH.

Bleeding Disorders of the Heartland makes every effort to ensure that the members of the bleeding disorders community are always able to make a clear distinction between its own activities and those of Industry. Further, it is essential that we create beneficial and pressure-free experiences for our community at BDH events and programs. Accordingly, Bleeding Disorders of the Heartland has developed the following standards.

Use of BDH Materials in Industry Publications

The use of Bleeding Disorders of the Heartlands materials, including but not limited to the BDH logo, articles from its newsletter(s), brochures, event fliers, and its website, are expressly prohibited without advance written approval from the BDH Executive Director or authorized entity from the BDH.


Industry Representatives at BDH-hosted Events

  1. All Industry Representatives must identify themselves as such prior to the start (i.e.: at sign-in or registration) of an Event.
  2. Only BDH-approved Industry Representatives of duly registered Event sponsors may distribute marketing materials or any other materials during the Event, such distribution will be limited to agreed upon materials and area.
  3. Industry Representatives may not attend a BDH Event (excluding fundraising events) unless their company is one of the sponsors or BDH has granted permission of the industry representative to attend solely as a consumer and does not represent the industry in any fashion.
  4. Any attempts to collect consumer information at events must be approved by the BDH Executive Director in writing prior to the event. Once information collection methods are approved by the BDH Executive Director, the specific approval is valid unless the information collection process is altered. Any Industry information collection process changes should be made known to the BDH Executive Director. BDH has the right to review the information collection process at any time. Please consult with BDH Executive Director staff for specific details regarding information collection methods.
  5. No company or Industry Representative may conduct any official meeting, presentation, or other activity without notifying the BDH Executive Director in advance. Any meeting, presentation, or other activity conducted by an Industry Representative needs to be communicated to BDH at least one month prior to the event.
  6. BDH retains the right to reject any proposed presentation that is contrary to the goals of the BDH chapter or event.
  7. BDH will not be responsible for transporting, storing, shipping, setting up or displaying any materials for Industry use at Events.
  8. No photos or videos may be taken during any Event without the written and expressed consent of the participant and prior approval from the BDH Executive Director.
  9. Industry Representatives must agree to abide by any additional standards set forth by the BDH Executive Director that may pertain to specific Events. Any such additional standards will be provided and communicated to Industry event sponsors and exhibitors during time of solicitation request.
  10. BDH will maintain all RSVP lists. Industry Representatives may not add or invite participants without BDH Executive Director written consent.
  11. BDH acknowledges that during an educational event, a situation may arise when an Industry Representative plays a dual role by working as a representative at their company exhibit/booth AND participating as a speaker/moderator. Please consult with the BDH Executive Director regarding what is allowable.


Additional Standards of Behavior for Industry Representatives Who Are Also Consumers

Industry representatives are allowed to attend any BDH event as a consumer, but only if they reside within the BDH service area. As such, they should be registered as a member of BDH.

If attending as a Consumer, persons:
1. Will not use any information obtained because of attendance or participation in any other purpose other than attendance or participation in such events/programs.

2. Must not conduct any marketing activity for the duration of the Event (marketing activity includes but is not limited to wearing company apparel, handing out business cards, giving out logo items, etc.)

3. Will not solicit name or addresses of attendees and must ensure that all attendees’ personal information acquired during the Event is kept in confidence and will not be used for any Industry-related marketing, sales, or financial gain of any kind.

Confidentiality Standards

All Industry Representatives must abide by the Bleeding Disorders of the Heartland Confidentiality Standards to ensure that event participants feel comfortable sharing personal information. See BDH Executive Director for a copy of the confidentiality standards.

Violation of these standards may result in penalties to the individual in violation, or to their entire Industry organization. Penalties may include additional restrictions, the assessment of additional fees, or forfeiture of the privilege to attend future programs and events with Bleeding Disorders of the Heartland.
